How to use this calculator

Pick PF or ESI, enter the contribution that was paid late and how late it was. You get the interest, and for PF the damages, separately.

  1. 1
Choose PF or ESI. The two schemes use the same 12% a year interest, but only PF damages are calculated here. ESI damages are decided by ESIC after a notice.
  2. 2
Enter the contribution paid late. The employer and employee contribution that was due and paid after the due date. For PF this covers the provident fund, pension and insurance parts together.
  3. 3
Enter the days and months late. Count from the day after the 15th-of-the-month due date to the day you paid. Interest uses the days. PF damages use the months, and a part of a month counts as a whole month.
  4. 4
For PF, say when the contribution was due. The 1% a month damages rate applies to a contribution due on or after 15 June 2024. For earlier defaults the calculator shows interest only, and the damages figure comes from your notice.

What a late PF or ESI payment costs

Both PF and ESI contributions are due by the 15th of the month after the wages were paid. Pay after that and two different charges can follow: interest, which is automatic, and damages, which are a separate penalty. Founders often see them lumped together in a demand notice, so this calculator separates them.

Interest on PF (section 7Q)
Simple interest at 12% a year on the late amount, from the due date until the day it is actually paid.
Damages on PF (section 14B)
For a contribution due on or after 15 June 2024, 1% of the arrears for each month or part of a month of delay. Total damages cannot go beyond 100% of the arrears.
Interest on ESI (section 39(5))
Simple interest at 12% a year for every day the contribution is late.
Damages on ESI (section 85B)
ESIC can levy damages after issuing a notice, up to the amount of the arrears. They are at its discretion rather than automatic, so the amount in your notice is the figure that counts.

The Code on Social Security, 2020 started to apply from 21 November 2025 and brings PF and ESI under one law, with the existing schemes and regulations continuing during the changeover. The rates here are the ones in those schemes and regulations, and the section numbers above are the older ones. Your notice will name the section it relies on.

How the amounts are worked out

Interest = late amount × 12% × days late ÷ 365 | PF damages = late amount × 1% × months late (capped at the late amount)

  • Interest is simple, not compounded, and counts each day from the day after the due date to the day of payment.
  • Damages count months, and any part of a month is a full month, so 31 days late is 2 months of damages.
  • The late amount is the contribution not paid on time, not your whole payroll, so only the late part attracts the charges.

A startup pays ₹2,00,000 of PF contribution, due after 15 June 2024, 73 days late:

Interest (₹2,00,000 × 12% × 73 ÷ 365)
₹4,800
Months late (73 days is 2 months and 13 days, so 3)
3
Damages (₹2,00,000 × 1% × 3)
₹6,000

Interest + damages = ₹4,800 + ₹6,000 = ₹10,800, on top of the ₹2,00,000 contribution.

A startup pays ₹50,000 of ESI contribution 73 days late:

Interest (₹50,000 × 12% × 73 ÷ 365)
₹1,200

Interest = ₹1,200. Any damages come only if ESIC sends a notice, and are not included.

The 2024 change in PF damages

Before June 2024, PF damages were charged on a scale that rose with the length of the delay, from 5% to 25% of the arrears a year. A 2024 amendment to the PF Scheme replaced that with a single rate of 1% of the arrears for each month or part of a month. It applies to defaults from 15 June 2024 and does not reach back to earlier ones. Firms differ on whether the first day is 14 or 15 June, but since PF is due on the 15th and a default starts the day after, a contribution due on or after 15 June 2024 is clearly covered.

At 1% a month, damages equal the whole arrears after 100 months, which is where the 100% cap takes over. The older scale is not calculated here because the sources describing how it was applied disagree. If your default is older, take the damages from your notice. EPFO has also offered a time-limited settlement scheme with reduced damages on older disputed defaults; check EPFO's circular for whether it is still open.

Other consequences of paying late

  • Tax deduction: the employee's share of PF or ESI deposited after the due date under the relevant law can be disallowed as a business expense in your income tax computation.
  • Notices and recovery: the department can issue a notice, hold an inquiry and recover the dues from your bank account.
  • Employee impact: late PF deposits delay the credit in your employees' accounts and can affect their claims.
  • Interest is not optional: it is payable even when damages are reduced or waived.

How to avoid the charges

  • Pay by the 14th. Both PF and ESI are due on the 15th, and there is no safe margin after it.
  • Pay the late amount as soon as you notice. Interest runs daily, so each day of delay costs about 0.033% of the amount (12% ÷ 365).
  • Reconcile your payroll to the challan every month. A short payment on one employee still counts as a late payment on that amount.
  • Respond to a notice within the time it gives. If damages are discretionary, a written reply explaining the delay is your best chance of a reduction.

Common mistakes

  • Using the old 5% to 25% scale for a recent default. Contributions due from 15 June 2024 are charged at 1% a month.
  • Charging damages on the whole payroll. The base is the amount that was paid late.
  • Forgetting that part of a month is a whole month for PF damages.
  • Treating interest and damages as alternatives. For PF, EPFO demands both, and for ESI the interest is due whatever the damages are.
