Why must a sale deed be registered?

Under Section 17 of the Registration Act, 1908, a document purporting to transfer immovable property of value above ₹100 must be registered. An unregistered deed cannot be used as evidence of ownership and has no legal effect against third parties.

How is stamp duty calculated?

Stamp duty is calculated as a percentage of the property's market value or the consideration stated in the deed, whichever is higher. The rate varies by state and by property type. We compute the correct duty for your state and property.

What is an encumbrance certificate and why is it needed?

An encumbrance certificate is an official record of all registered transactions on the property — mortgages, sales, court attachments — over a specified period. A clean EC confirms there are no outstanding charges on the property before you buy it.

The circle rate is the minimum value prescribed by the government for stamp duty purposes. Stamp duty cannot be less than the duty on the circle rate, even if the actual sale price is lower.

How long does registration take?

Once both parties appear at the Sub-Registrar's office, registration is typically completed the same day. Scheduling an appointment and preparing all documents takes 3–5 working days.

Do I need a lawyer for a property sale?

Banks provide standard deed templates optimised for their own protection, not yours. An independent legal review confirms the title chain and ensures the deed protects the buyer's interests specifically.
