इस सब्सिडी के बारे में
The Biotechnology Industry Research Assistance Council (BIRAC), a Public Sector Undertaking of the Department of Biotechnology, Government of India, invites applications for its BIRAC-PATH (Patenting and Technology Transfer for Harnessing Innovations) programme. This initiative is designed to provide end-to-end support for the protection of valuable biotech innovations, both within India and internationally. The program aims to empower innovators by easing the financial and procedural burden of securing intellectual property rights, a critical step for commercialization and market entry. By offering strategic guidance and leveraging empaneled IP and Technology Transfer firms, BIRAC-PATH ensures that promising innovations receive robust IP protection.
The scope of support covers various stages of patent filing, including provisional and complete applications in India, as well as complex international filings like PCT, Convention, and National Phase applications. Beyond mere financial assistance, the program also incorporates essential services such as patent search and analysis, which includes patentability assessment, Freedom-to-Operate (FTO) analysis, state-of-the-art searches, and landscape studies. This holistic approach ensures that applicants not only secure their patents but also understand the broader IP landscape relevant to their innovations. While this specific call focuses on patent facilitation, the wider BIRAC-PATH program also encompasses technology transfer facilitation, creating a pathway from innovation to market.
BIRAC's commitment through this program is to foster a vibrant biotech innovation ecosystem by removing key barriers to IP protection, which is often a significant challenge for early-stage startups and research institutions. The program is vital for biotech entities that rely heavily on proprietary technology to gain a competitive edge. By ensuring IP ownership remains with the applicant while BIRAC facilitates the process, the program encourages direct engagement and long-term benefit for the innovators.

आपको क्या मिलेगा
BIRAC-PATH offers significant financial assistance for the protection of biotech innovations. For BIRAC-supported entities, non-BIRAC supported entities, and Private Research Institutions, the program provides up to 70% co-funding for patent drafting, filing, and prosecution costs in various jurisdictions (India, PCT, Convention, National Phase) until the grant of patent or commercialization, whichever occurs earlier. Applicants in this category are required to contribute a minimum of 30% of the costs. For Government Institutes and Universities, BIRAC offers 100% grant-in-aid covering all drafting, filing, and prosecution expenses until patent grant or commercialization. Beyond financial support, the program provides strategic guidance and hands-on support throughout the patenting journey, facilitated by empaneled IP & Technology Transfer firms. This includes essential services like patent search and analysis, freedom-to-operate studies, and technology landscape analysis. While BIRAC does not take ownership of the patents, a benefit-sharing mechanism is in place, requiring 5% of Annual Net Sales until the benefits paid equal the funding disbursed (or 7% if already under another BIRAC royalty scheme). License-out or assignment of the patent requires prior BIRAC permission and entails benefit sharing at 1.5 times the funding provided.

समयसीमा और प्रक्रिया
चयन प्रक्रिया
Applications undergo a review process by BIRAC. Key factors for consideration include the relevance of the innovation to biotechnology/life sciences, adherence to eligibility criteria, and the timing of the patent filing deadline (must fall within 4-6 months from the call announcement). Applications submitted too close to their patent filing deadline may be rejected. The selection committee evaluates the merits of the innovation and the strategic need for patent protection to determine suitability for co-funding or grant-in-aid support. Once an application is recommended, applicants proceed to formal agreements for facilitation.

अक्सर पूछे जाने वाले प्रश्न
What kind of IP protection does BIRAC-PATH support?
BIRAC-PATH supports various types of patent applications, including Provisional and Complete applications in India, as well as international filings such as PCT (Patent Cooperation Treaty), Convention applications, and National Phase applications in up to three countries. The program also covers essential services like patent search, analysis, and strategic IP guidance.
Who is eligible to apply for BIRAC-PATH?
Eligible applicants include BIRAC-supported entities (startups, companies, MSMEs, institutes/universities with prior BIRAC funding) and non-BIRAC supported startups/MSMEs incubated at any BIRAC-established BioNEST Centre working in biotechnology/life sciences. Applicants must be legal entities with at least 51% Indian shareholding or recognized universities/institutes.
Is there a financial contribution required from the applicant?
Yes, for BIRAC-supported entities, non-BIRAC supported entities, and Private Research Institutions, BIRAC provides up to 70% co-funding, meaning the applicant must contribute a minimum of 30% towards patent drafting, filing, and prosecution costs. Government Institutes and Universities receive 100% grant-in-aid and do not need to contribute financially.
Does BIRAC take ownership of the patents?
No, BIRAC does not take ownership of the patents filed with its assistance. The patent applications remain in the name of the applicant entity (host Institute/University/Company/Start-up/MSME). However, a benefit-sharing model applies upon commercialization or licensing of the patent.
How do I apply for the BIRAC-PATH program?
Applications must be submitted online only through the BIRAC portal via the Invention Disclosure Form (IDF). Existing BIRAC entities can log in with their credentials, while non-BIRAC entities need to register as new users. Email applications are not accepted, and applications submitted close to the filing deadline may not be considered.
What happens after my application is recommended for support?
If your application is recommended, you will need to execute a BIRAC-PATH Order and a Power of Attorney. This authorizes BIRAC to facilitate the patent drafting and filing process through its empaneled IP and Technology Transfer firms. The program aims to provide strategic guidance and support throughout the patenting journey until the grant of the patent or commercialization.
