How to write a probation confirmation letter

  1. 1

    Review the probation

Before the end date, decide whether to confirm, extend or end, based on the person's actual work.

  2. 2

    Pick the outcome and tone

Confirmed or probation extended, in a formal or warm voice.

  3. 3

Take the dates from your records

Enter the date of joining and the confirmation date (or the original end date, for an extension) from the appointment letter and payroll.

  4. 4

    State what changes

Add the post-confirmation notice period and any revised CTC, or for an extension the new end date, the reason and the goals.

  5. 5

Check it against the appointment letter

Make sure the notice period, benefits and any extension match what the contract and HR policy allow.

  6. 6

    Sign, send and file

Issue it on letterhead before the probation end date, get a signed acknowledgement, and update HR and payroll records.

What probation means, and what a confirmation letter does

Probation is a trial period at the start of a job. The company watches how the person actually works, the person finds out whether the role suits them, and either side can usually walk away more easily than later on. At most Indian startups it runs for three to six months, but that is practice, not a rule.

In India, probation is mostly a matter of contract. Its length, whether it can be extended, and the notice period during it come from the appointment letter and your HR policy. Where certified or model standing orders apply to your establishment, or your state's shops and establishments rules say something, those apply too. There is no single statutory rule a template can quote for every company, so check your own contract, standing orders or state rules, or ask your HR or legal adviser.

A confirmation letter closes the trial period in writing. It says the person is now a confirmed employee from a stated date, and it records what changes from that date: usually the notice period, sometimes pay and benefits. Without one, the person and your payroll team are left guessing which set of terms now applies.

Confirm, extend or end: the three outcomes

At the end of probation, one of three things should happen, and each needs its own letter. The worst outcome is the fourth one nobody plans: the date passes and nothing is said. Whether the person is then treated as confirmed depends on how the appointment letter is worded, and it is an argument you do not want to have.

What changes on confirmation

Confirmation does not rewrite the employment contract. It switches on the parts of it that were waiting for this date. Write each change down in the letter so nobody has to dig out the appointment letter to know where they stand.

Notice period
Most appointment letters set a short notice period during probation and a longer one after confirmation. State the post-confirmation period in the letter, or point clearly to the clause that sets it.
Pay
Some companies revise pay on confirmation; many do not. If CTC changes, state the new annual figure and the date it applies from, and share the revised salary breakup separately.
Benefits and leave
Some policies hold back benefits such as certain leave types, insurance top-ups or ESOP eligibility until confirmation. Say they now apply as per policy, rather than listing them in the letter, so the letter does not go out of date when the policy changes.
Everything else stays the same
Role, reporting line, location and other terms carry on as in the appointment letter unless the confirmation letter says otherwise. If you are also changing the role, say so explicitly or use a separate letter.
Your records
Update the HR system, payroll and any policy-linked benefits from the effective date, and file the signed copy with the appointment letter.

How to extend probation fairly

An extension should be a real second chance, not a slow exit. Done well, it tells the person exactly what is not yet working and what good looks like by a fixed date. Done badly, it reads as a pretext, and that is what turns an ordinary decision into a dispute.

Check you can extend
Read the appointment letter and your HR policy first. Some allow one extension of a stated length; some say nothing. If yours is silent or caps the total, ask your HR or legal adviser before you issue the letter.
Decide before the end date
Issue the extension letter before probation is due to end, not after. A letter dated after the end date invites the argument that the person was already confirmed.
Give a specific, factual reason
Name the work, with examples: missed response times, reviews submitted incomplete. Avoid remarks about personality or attitude that you cannot point to.
Set goals they can meet in the time
Two or three measurable expectations, matched to the length of the extension. Goals nobody could meet make the extension look like a formality.
Review it properly
Meet during the extension, give feedback, and keep a short note of each review. Then decide in writing before the new end date.
Do not extend again and again
One extension is common. A second or third usually means the decision is being avoided. Confirm or end, with advice if needed.

Got a confirmation or extension letter? Check these things

This letter changes the terms you work on, so read it as carefully as your offer letter. Ask HR to correct anything that is wrong now; it is much harder to fix after a dispute or when you move jobs.

The dates
Your date of joining and the confirmation or new probation end date should match your appointment letter and payroll records.
Your notice period
Check what it is after confirmation, and that it matches the appointment letter or HR policy it refers to.
Any pay change
If the letter says your CTC changes, check the figure and the date it applies from, and ask for the revised salary breakup.
On an extension: the reason and the goals
They should be specific enough that you know exactly what to do differently. If they are vague, ask your manager in writing what 'meeting the standard' means.
Keep a signed copy
Sign the acknowledgement, keep a copy, and keep any feedback you receive during an extension.

What goes wrong

Most problems with confirmation letters come from timing and vagueness rather than wording.

No letter at all
The probation date passes silently, and months later nobody can say which notice period applies.
An extension issued late
Dated after probation ended, it is easy to challenge. Diary the end date when the person joins.
A reason that is really a judgement
'Not a culture fit' tells the person nothing and is hard to defend. Describe the work instead.
Promises the policy does not back
Do not list benefits or bonuses the policy does not actually give confirmed employees. Point to the policy.

Frequently asked questions

What is a probation confirmation letter?

A letter from the employer telling an employee that they have completed probation and are confirmed in their role from a stated date. It usually also records the notice period that applies from then and any change in pay or benefits.

Is a confirmation letter mandatory in India?

There is no single rule that applies to every company. Whether one is needed, and what happens if none is issued, depends on your appointment letter, HR policy and any standing orders that apply to your establishment. In practice, always issue one. It removes doubt about which terms now apply.

What if the probation period ends and no letter is issued?

Whether the employee is then treated as confirmed depends on the wording of the appointment letter and the facts, and it is a common source of disputes. Do not leave it to chance: confirm, extend or end in writing before the end date. If the date has already passed, ask your HR or legal adviser how to handle it.

Can an employer extend probation?

Usually, if the appointment letter or HR policy allows it. Check what yours says about extensions and any maximum. Give the reason in writing, set clear goals and a new end date, and issue the letter before the original probation ends.

How long can probation be extended?

It depends on your contract and policy; there is no one figure for every company. Many startups extend once, for a period similar to or shorter than the original probation. Repeated extensions are hard to justify and should prompt a decision.

Does the notice period change after confirmation?

Often, yes. Many appointment letters set a shorter notice period during probation and a longer one once confirmed. The confirmation letter should state the new period or point to the clause that sets it.

Does salary increase on confirmation?

Not automatically. Some companies revise pay on confirmation and many do not. If yours does, put the new annual CTC and the effective date in the letter and share the salary breakup separately.

Can probation be ended instead of extended?

Yes, if the contract's probation terms allow it, but that needs a separate letter, not this one. Follow the notice terms in the contract, keep your review notes, and take HR or legal advice before you issue it.

I'm an employee and my probation was extended. What should I do?

Read the reason and the goals carefully and ask your manager to clarify anything vague, in writing. Ask for regular feedback during the extension, keep a record of your work against the goals, and sign the acknowledgement so you have a copy.

Does the letter need a stamp or stamp paper?

No stamp paper is needed. Issue it on company letterhead, signed by an authorised person, and have the employee sign a copy to acknowledge it. An emailed, signed PDF is common; electronic records are recognised under the Information Technology Act, 2000.
