What is Trademark Renewal?

File Form TM-R to renew your Indian trademark registration before the 10-year expiry. We monitor your portfolio and alert you 6–12 months in advance. Late renewal (within 6 months post-expiry) carries a surcharge of ₹4,500 per class.

Trademark renewal is filed using Form TM-R. Renewal filed within the prescribed period keeps the registration continuous — there is no gap in protection. If renewal is missed entirely (beyond 6 months post-expiry), the mark is removed from the register and would need to be re-applied as a fresh trademark application.

⚠️ Penalty for Non-Compliance

If a trademark expires and the 6-month post-expiry restoration window is missed, the mark is removed from the register. A competitor can then file for the same mark, and you would have to contest their application or re-apply and restart the 18–24 month registration process.

When should I file for trademark renewal?

Within 6 months before the expiry date (to avoid surcharge) or within 6 months after expiry (with a surcharge of ₹4,500 per class). Filing early is always recommended.

Does the trademark need to be in use for renewal?

Renewal is not conditional on use. However, if the trademark has not been used for 5+ consecutive years, any party can file for cancellation on grounds of non-use.

What is the government fee for trademark renewal?

₹9,000 per class by e-filing, the same for every applicant; the MSME and startup concession applies only to new applications, not renewals. Renewing within 6 months after expiry adds a surcharge of ₹4,500 per class.

How long does renewal take?
