What is Trademark Renewal?

File Form TM-R to renew your Indian trademark registration before the 10-year expiry. We monitor your portfolio and alert you 6–12 months in advance. Late renewal (within 6 months post-expiry) carries a 25% surcharge.

Trademark renewal is filed using Form TM-R. Renewal filed within the prescribed period keeps the registration continuous — there is no gap in protection. If renewal is missed entirely (beyond 6 months post-expiry), the mark is removed from the register and would need to be re-applied as a fresh trademark application.

Frequently Asked Questions

When should I file for trademark renewal?

Within 6 months before the expiry date (to avoid surcharge) or within 6 months after expiry (with a 25% surcharge on government fee). Filing early is always recommended.

Does the trademark need to be in use for renewal?

Renewal is not conditional on use. However, if the trademark has not been used for 5+ consecutive years, any party can file for cancellation on grounds of non-use.

What is the government fee for trademark renewal?

₹4,500 per class for MSME/startups (same as the original registration fee). ₹9,000 per class for others. A 25% surcharge applies for renewals filed within 6 months after the expiry date.

How long does renewal take?

The formal renewal is processed quickly — typically within a few weeks. A fresh certificate is issued within 3–6 months. In the meantime, the renewal filing receipt is sufficient proof of continued protection.
