India follows the NICE Classification system — 45 classes covering all goods (Classes 1–34) and services (Classes 35–45). Any business that has a brand name, logo, tagline, or distinctive packaging should register a trademark before going public or investing in marketing. E-commerce sellers on Amazon (Brand Registry), Flipkart, and Meesho are required to have a registered trademark.
⚠️ Penalty for Non-Compliance
Using a ® symbol without a registered trademark is a criminal offence under the Trade Marks Act 1999 (up to 3 years imprisonment and ₹2 lakh fine). An unregistered brand can be copied by competitors — you have limited legal recourse without registration.
Trademark Search

Application Filing (Form TM-A)

Publication in Trademark Journal
On acceptance, the mark is published in the weekly Trademark Journal. Third parties have 4 months to oppose.
Registration Certificate
If no opposition is received (or opposition is won), the Registry issues the Registration Certificate. The mark is valid for 10 years from the filing date.

The total process typically takes 18–24 months to receive the official Registration Certificate. However, you can use the ™ symbol and initiate infringement action from the date of filing.
