How long does trademark registration take in India?

The total process typically takes 18–24 months to receive the official Registration Certificate. However, you can use the ™ symbol and initiate infringement action from the date of filing.

What is the government fee for trademark registration?

₹4,500 per class for MSME/startups with a Udyam certificate; ₹9,000 per class for other entities. Each additional class is charged separately.

What can I trademark?

Words, logos, taglines, shapes, colours, sounds, and even smells can be trademarked if they are distinctive and not descriptive. You cannot trademark generic words like 'Best' or 'India' on their own.

What is the difference between TM and ®?

™ (Unregistered Trademark) can be used from the date of application to indicate your claim. ® (Registered Trademark) can only be used after the certificate is granted. Misusing ® is a criminal offence.

Can I register a trademark if someone else has a similar name?
