Mandatory registration for manufacturers, packers, and importers of packaged commodities

Legal Metrology in India is administered by the Department of Consumer Affairs under the Ministry of Consumer Affairs, Food and Public Distribution. The Legal Metrology Act 2009 governs weights, measures, and packaged commodities across the country. The Act replaced the Standards of Weights and Measures Act 1976 and introduced a more comprehensive regulatory framework. The Legal Metrology (Packaged Commodities) Rules 2011 specify mandatory declarations required on every pre-packaged commodity sold in India, while the Legal Metrology (General) Rules 2011 govern the approval and verification of weights and measures. Every manufacturer, packer, or importer of pre-packaged commodities with a net quantity must register with the state-level Controller of Legal Metrology. Registration is required before commencement of manufacturing or packing activity. The registration certificate specifies the categories of goods covered and the premises for which registration is granted. Mandatory labelling requirements under the Packaged Commodities Rules include the name and address of the manufacturer or packer, country of origin for imported goods, common or generic name of the commodity, net quantity in standard units, date of manufacture or packing, best-before or expiry date where applicable, maximum retail price inclusive of all taxes, consumer care details, and size or dimension where relevant. FMCG companies, food manufacturers, pharmaceutical companies, and importers of any pre-packaged goods must comply with these requirements. Failure to display mandatory information or displaying incorrect information attracts monetary penalties up to fifty thousand rupees for first offence and up to one lakh rupees for subsequent offences, plus product confiscation.
Manufacturers, packers, importers, re-packers, and retailers dealing in any pre-packaged commodity including food, cosmetics, pharmaceuticals, hardware, electronics accessories, and household goods where the product is sold in sealed packaging with a declared net quantity.
⚠️ Penalty for Non-Compliance
Non-registration and labelling violations attract penalties up to Rs 50,000 for first offence and up to Rs 1,00,000 for repeat offences under Section 36 of the Legal Metrology Act 2009. Products can be seized by Inspectors under Section 13.
